1. General Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Buyer," "Customer," or "you") and Mid-Atlantic Imports, LLC ("Seller," "we," "us," or "our"), a Federal Firearms Licensee (FFL) located in Woodbine, Maryland. By placing an order through our website, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. Eligibility and Legal Requirements
2.1 Age Requirements
-You must be at least 18 years of age to purchase long guns (rifles and shotguns)
-You must be at least 21 years of age to purchase handguns
-You must be at least 18 years of age to purchase ammunition for long guns
-You must be at least 21 years of age to purchase ammunition for handguns
2.2 Legal Status
By placing an order, you certify that you:
-Are a legal resident of the United States
-Are not a prohibited person under federal or state law
-Are not subject to any restraining orders or court orders prohibiting firearm possession
-Have not been convicted of a felony or domestic violence misdemeanor
-Are not an unlawful user of or addicted to controlled substances
-Have not been adjudicated as mentally defective or committed to a mental institution
-Are not an illegal alien or unlawfully in the United States
-Have not renounced your United States citizenship
-Are purchasing the firearm for yourself and not as a "straw purchase" for another person
2.3 State and Local Compliance
You are responsible for knowing and complying with all federal, state, and local laws governing firearm ownership, possession, and use in your jurisdiction. We reserve the right to refuse any sale that we believe may violate applicable laws.
3. FFL Transfer Requirements
3.1 Required Documentation
All firearms must be transferred through a licensed Federal Firearms Licensee (FFL). Prior to shipment, you must:Provide us with the contact information of your receiving FFL dealerEnsure your receiving FFL sends us a copy of their current FFL license (via email, fax, or mail)Verify that your receiving FFL is willing to accept the transfer
3.2 Transfer Process
Firearms will only be shipped to a valid FFL dealer, not to individual addresses
-You are responsible for any transfer fees charged by your receiving FFL
-You must complete ATF Form 4473 and pass a NICS background check at your receiving FFL
-Your receiving FFL may have additional requirements or waiting periods
3.3 Refused Transfers
If you fail a background check or refuse to complete the transfer, the firearm will be returned to us. You will be responsible for return shipping costs and may be subject to a restocking fee of up to 20% of the purchase price. Refunds will be issued minus shipping costs and restocking fees.
4. Ordering and Payment
4.1 Order Acceptance
All orders are subject to acceptance by Mid-Atlantic Imports, LLC. We reserve the right to refuse or cancel any order for any reason, including but not limited to:
-Suspected fraud or illegal activity
-Pricing or product description errors
-Product availability issues
-Compliance concerns with applicable laws
-Failure to provide required FFL documentation
4.2 Payment
-Payment is due in full at the time of order
-We accept major credit cards, debit cards, and other payment methods as indicated on our website
-All prices are in U.S. Dollars and exclude applicable taxes and shipping
-Prices are subject to change without notice
4.3 Sales Tax
Sales tax will be collected on orders shipped to Maryland and any other states where we have a tax collection obligation, as required by law.
5. Shipping and Delivery
5.1 Shipping Methods
-Firearms will be shipped via a common carrier approved for firearm shipments (typically USPS or UPS)
-Adult signature (21+) is required for all firearm deliveries to FFL dealers
-We ship Monday through Friday, excluding federal holidays
-Typical processing time is 1-3 business days after receipt of valid FFL documentation
5.2 Shipping Costs
Shipping costs are calculated at checkout based on the destination and shipping method selected. Actual shipping costs will be clearly displayed before you complete your purchase.
5.3 Delivery Timeline
Estimated delivery times are provided as a courtesy and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather, FFL availability, or other factors beyond our control.
5.4 International Shipping
We do not currently ship firearms or ammunition outside of the United States. Export of firearms requires federal approval and proper licensing.
6. Returns and Exchanges
6.1 Return Policy
Due to the nature of firearm sales, all sales are final once the firearm has been transferred to your receiving FFL. Returns MAY only accepted under the following limited circumstances:
-The firearm was damaged during shipping (must be reported within 24 hours of receipt by FFL)
-We shipped the incorrect item
-The firearm is materially different from the description provided
6.2 Inspection Period
You have 3 business days from the date your receiving FFL receives the firearm to inspect it while it remains at the FFL. You must notify us of any issues during this period. Once you complete the transfer and take possession, the sale is final.
6.3 Return Process
To initiate a return:
-Contact us immediately with photos and detailed description of the issue
-Do not complete the transfer or take possession of the firearm
-We will arrange return shipping with your FFL at our expense (if the return is due to our error)
-Refunds will be issued to the original payment method within 10 business days of receiving the returned item
6.4 Non-Returnable Items
The following items cannot be returned:
-Ammunition (all sales final)
-Firearms that have been fired or modified after transfer
-Custom ordered or special order itemsItems returned without prior authorization
7. Product Descriptions and Condition Grading
7.1 Accuracy
We strive to provide accurate descriptions and photographs of all products. However, product descriptions, specifications, and condition assessments are provided for informational purposes and may contain inadvertent errors or omissions. We reserve the right to correct any errors or inaccuracies.
7.2 Used and Surplus Firearms
Many of our firearms are military surplus, antique, or used firearms. These items:
-May show signs of wear, use, or aging consistent with their age and history
-Are sold in "as-is" condition unless otherwise specified
-May have import markings as required by U.S. law
-May have variations in finish, markings, or accessories from original military configuration
7.3 Functionality
Unless specifically noted as non-functional or "parts gun," all firearms are sold as functional firearms. We inspect all firearms prior to listing, but we recommend having any used or surplus firearm inspected by a qualified gunsmith before firing.
8. Warranty and Liability
8.1 Limited Warranty
We warrant that firearms will be as described and free from defects in materials that render them unsafe or non-functional. This warranty is limited to repair, replacement, or refund at our sole discretion. This warranty does not cover:
-Normal wear and tear
-Damage from misuse, abuse, or improper storage
-Modifications made after purchase
-Cosmetic issues that do not affect function
-Vintage or antique firearms sold in "as-is" condition
8.2 Disclaimer of Warranties
EXCEPT AS EXPRESSLY SET FORTH ABOVE, ALL PRODUCTS ARE SOLD "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
8.3 Limitation of Liability
IN NO EVENT SHALL MID-ATLANTIC IMPORTS, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR PURCHASE OR USE OF ANY PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE PURCHASE PRICE OF THE PRODUCT.
8.4 Safe Use
You acknowledge that firearms are inherently dangerous and can cause serious injury or death if misused. You agree to:
-Use all firearms safely and responsibly
-Follow all manufacturer safety instructions
-Use appropriate ammunition as specified by the manufacturer
-Store firearms securely and away from unauthorized users
-Comply with all applicable laws regarding use, storage, and transportation9.
9. Privacy and Data Protection
We collect and maintain certain information as required by federal law, including ATF Form 4473 records. Our use of your personal information is governed by our Privacy Policy. By making a purchase, you consent to our collection and use of your information as described in our Privacy Policy.
9.1 Record Retention
As required by federal law, we maintain records of all firearm transactions for a minimum of 20 years. These records include:
-ATF Form 4473 (maintained by receiving FFL)
-Our acquisition and disposition records
-Shipping and transfer documentation
10. Prohibited Conduct
You agree not to:
-Make false statements regarding your eligibility to purchase firearms
-Attempt to purchase firearms as a straw purchaser for another person
-Use our website or services for any illegal purpose
-Circumvent or violate any applicable laws or regulations
-Resell firearms without proper federal licensing
-Export firearms without proper authorization
-Modify firearms in violation of federal or state law (e.g., creating illegal short-barreled rifles)
11. Intellectual Property
All content on our website, including text, images, logos, and product descriptions, is the property of Mid-Atlantic Imports, LLC or our licensors and is protected by copyright and trademark laws. You may not use, reproduce, or distribute any content without our express written permission.
12. Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Maryland and the federal laws of the United States, without regard to conflict of law principles.
12.2 Jurisdiction and Venue
Any legal action or proceeding arising out of or relating to these Terms or any transaction shall be brought exclusively in the state or federal courts located in Howard County, Maryland, and you consent to the jurisdiction of such courts.
12.3 Informal Resolution
Before initiating any formal legal action, you agree to contact us to attempt to resolve the dispute informally. Most disputes can be resolved through communication.
13. Miscellaneous
13.1 Entire Agreement
These Terms, together with our Privacy Policy and Shipping Policy, constitute the entire agreement between you and Mid-Atlantic Imports, LLC regarding your purchase.
13.2 Modifications
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our website after changes are posted constitutes acceptance of the modified Terms.
13.3 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13.4 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
13.5 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
